Dealing with a rejected insurance claim can be a stressful and challenging experience, particularly when the rejection arrives in a one-page letter citing a clause in the policy you may not have fully read. The good news is that a first-pass rejection is rarely the end of the road. A loss assessor reviews the rejection grounds, builds a counter-case, and presents it through the insurer’s internal complaints process and, where necessary, the Financial Services and Pensions Ombudsman (FSPO). N.J. Carroll & Associates have overturned hundreds of rejected claims since 1988.
How to Challenge A Rejected Insurance Claim
Read the rejection letter carefully. Note the specific policy clause cited and the factual basis for the decision.
Do not respond emotionally. The first letter back from a frustrated policyholder often hardens the insurer’s position. Pause.
Pull the policy document and the schedule. The rejection letter cites a clause; verify it is actually in your policy and that it applies to your facts.
Compile every piece of evidence about the loss event. Photographs, receipts, repair quotations, professional reports, weather records.
Engage a loss assessor for a second opinion. We routinely overturn first-pass rejections by reframing the cause, evidencing the peril correctly, or pointing to a section of cover the original claim missed.
Submit a formal complaint to the insurer. Each Irish insurer has an internal complaints procedure with a defined response time, usually 40 working days.
Escalate to the Financial Services and Pensions Ombudsman if needed. The FSPO is independent, free to use, and binds the insurer to its determinations.
Engage solicitors only when needed. Most rejected claims are resolved without legal proceedings.
Remember, the first rejection is the start of the conversation, not the end of it. Documentation, the right policy clause, and persistence settle most disputed claims.
Common reasons claims are rejected
Wear and tear. The most-cited rejection reason. Often arguable.
Lack of maintenance. Insurers argue the loss was preventable.
Gradually operating cause. The leak/damage was not a sudden event.
Policy condition breach. Heating off in winter, alarm not set, vacancy beyond threshold.
Material non-disclosure. Something on the proposal form was wrong or missing.
Pre-existing damage. Damage existed before the policy started.
Cause not insured. The actual peril is not covered.
Sub-limit reached. Cover applies but the policy cap is hit.
How N.J. Carroll & Associates Can Help

Every conversation logged. Every offer presented to you in writing. You make every decision; we do the negotiation.
Maximum settlement secured
Detailed schedule, evidenced and presented. We push until the insurer pays the full entitlement, not the easy figure.

Furniture, appliances, soft furnishings, replaced new-for-old where the policy permits.
Alternative accommodation
If your home is uninhabitable, the insurer pays for somewhere to stay until reinstatement is complete.
Professional fees
Surveyors, architects and structural engineers when remedial work needs their input.
Debris removal

Frequently asked
Common rejected claim help claim questions
My claim has been rejected. Is the decision final?
Almost never. A first-pass rejection is the start of the conversation, not the end. We re-frame the claim, evidence the right peril, and escalate through the insurer's complaints process or, where needed, the Financial Services and Pensions Ombudsman.
Will my premium go up if I make a claim?
Some claims trigger a premium increase, some don't, and accidental-damage claims behave very differently from theft or subsidence claims. We'll advise on the wider implications BEFORE you decide to claim, not just push every loss through.
Is the loss adjuster the insurer sent on my side?
No. The loss adjuster works for the insurance company, their job is to validate the claim and contain its cost. Your loss assessor (us) works only for you, the policyholder. They are not the same role.
How much do you cost? When do I pay?
No win, no fee. Our fee is a percentage of the additional settlement we secure above the insurer's opening offer, agreed in writing up front. If we cannot improve on what the insurer would have paid you anyway, you owe nothing.
Can you visit me anywhere in Ireland?
Yes. Our office is in Dublin 6W and we serve every Irish county. Same-day site visits are routine for emergencies; standard non-emergency visits within 48 hours.
I've already made my claim and the insurer has offered me a settlement. Is it too late?
Not at all. We can step in at any stage of a claim, even after an offer has been made, and frequently improve the settlement. Don't accept the offer until you've spoken to us, signing accepts the figure as final.
