Dealing with public liability insurance claims can be a stressful and challenging experience for any business, particularly when an incident has injured a member of the public on your premises and the threatened claim could exceed your policy limits. Public liability claims are technically different to property claims; they are defended, not pursued. A loss assessor works alongside your solicitor to ensure your insurer engages properly with the claim against you and that the cover responds. N.J. Carroll & Associates have handled public liability claim management for Irish businesses since 1988.
How to Manage A Public Liability Claim
Make the scene safe and tend to anyone injured. Call emergency services where needed.
Photograph the scene. The hazard, the location, the conditions, and any signage. Same-day photographs are far more valuable than later reconstruction.
Take witness details. Names, contact details, what they saw.
Complete an internal incident report. Time, date, conditions, action taken.
Notify your insurer immediately. Public liability policies require prompt notification, often 24 to 48 hours.
Do not admit liability. An admission, even informally, can prejudice the claim.
Engage a loss assessor. The loss adjuster for public liability works for the insurer’s interests, which may diverge from yours, particularly on coverage points.
Coordinate with your solicitor where the matter goes legal. A loss assessor and a solicitor are complementary roles.
Track the claim through the insurer’s process. PIAB submission, settlement negotiation, court if it gets that far.
Address any remedial action on the premises to prevent repeat.
Remember, public liability claims are decided on the evidence as captured at the time. Same-day documentation is essential.
What is considered a public liability insurance claim?
A public liability claim arises when a third party (a customer, visitor, member of the public) is injured or has property damaged on your premises or as a consequence of your business activities, and seeks compensation. The cover responds where the business is legally liable.
Common public liability claim scenarios
Slip, trip and fall incidents on premises
Falling objects in retail or hospitality settings
Food poisoning or allergen incidents
Damage to a customer’s property or vehicle
Injuries on rented or borrowed equipment
Incidents involving subcontractors
Carpark and traffic incidents on premises
Injuries on rural premises (open farms, pet farms, equestrian businesses)
Does insurance cover public liability claims?
Most commercial policies include public liability cover, but the conditions matter:
Notification time limits. Late notification can void cover.
Limits of indemnity. The policy cap on any single claim.
Excess. The first portion the business pays.
Excluded activities. Some activities are outside the standard cover.
Risk-management conditions. Some policies require documented risk assessments and procedures.
How N.J. Carroll & Associates Can Help
We are one of Ireland’s most experienced loss-assessing firms, established 1988, regulated by the Central Bank of Ireland. Public liability is the area where loss assessors and solicitors most often work in tandem; we coordinate with your legal team rather than replace it. We act as the business’s representative on the insurance side, take the stress and worry off your hands, and ensure the policy responds properly. We are wholly independent and committed to your interests alone.
Our standard fee is 8% plus VAT of the recovery (where applicable), on a no-win, no-fee basis. The initial consultation is free.

Why a specialist matters
What you get with a Public Liability loss assessor
Immediate damage control
Same-day site visit. Make-safe and emergency repairs arranged. Claim opened before the insurer's adjuster lands.
Clear, ongoing updates
Every conversation logged. Every offer presented to you in writing. You make every decision; we do the negotiation.
Maximum settlement secured
Detailed schedule, evidenced and presented. We push until the insurer pays the full entitlement, not the easy figure.
Cover heads we claim
You are entitled to more than you think
Most home and commercial policies include cover heads policyholders never claim, simply because nobody told them. We read the policy line by line so nothing is left on the table.
Buildings reinstatement
Full structural repair to original specification, not depreciated "indemnity" value.
Contents
Furniture, appliances, soft furnishings, replaced new-for-old where the policy permits.
Alternative accommodation
If your home is uninhabitable, the insurer pays for somewhere to stay until reinstatement is complete.
Professional fees
Surveyors, architects and structural engineers when remedial work needs their input.
Debris removal
Make-safe, emergency boarding-up and full clearance of damaged materials.
Loss of metered services
Water, gas and electricity charged through during the claim period.

Frequently asked
Common public liability claim questions
A customer has been injured on my premises. What should I do first?
Document the scene with photographs, take witness details, complete an incident report, and notify your insurer immediately. Do not admit liability. Engage your solicitor where the matter goes legal; we work alongside them on the insurance side.
Will my premium go up if I make a claim?
Some claims trigger a premium increase, some don't, and accidental-damage claims behave very differently from theft or subsidence claims. We'll advise on the wider implications BEFORE you decide to claim, not just push every loss through.
Is the loss adjuster the insurer sent on my side?
No. The loss adjuster works for the insurance company, their job is to validate the claim and contain its cost. Your loss assessor (us) works only for you, the policyholder. They are not the same role.
How much do you cost? When do I pay?
No win, no fee. Our fee is a percentage of the additional settlement we secure above the insurer's opening offer, agreed in writing up front. If we cannot improve on what the insurer would have paid you anyway, you owe nothing.
Can you visit me anywhere in Ireland?
Yes. Our office is in Dublin 6W and we serve every Irish county. Same-day site visits are routine for emergencies; standard non-emergency visits within 48 hours.
I've already made my claim and the insurer has offered me a settlement. Is it too late?
Not at all. We can step in at any stage of a claim, even after an offer has been made, and frequently improve the settlement. Don't accept the offer until you've spoken to us, signing accepts the figure as final.
