Dealing with a loss of rent insurance claim can be a stressful and challenging experience, particularly because rental income stops the day the property becomes uninhabitable but the mortgage and other commitments do not. A loss assessor ensures the loss of rent section of the policy is invoked alongside the reinstatement claim, and that both heads of cover are settled in parallel. N.J. Carroll & Associates have handled landlord claims across Ireland since 1988.
How to Make A Loss of Rent Claim
Establish the date the property became uninhabitable. The clock starts on the loss event, not on the date the claim is reported.
Document the rent paid prior to the loss. Tenancy agreement, rent receipts, RTB registration. The historical rent is the basis for the claim.
Evidence the market rent at the time of the loss. If the property would have been re-let at a different figure, the claim should reflect that.
Notify the insurer of the loss of rent claim alongside the main reinstatement claim. They are separate heads of cover but presented together.
Read the policy schedule for the loss of rent indemnity period. Most landlord policies cover 12 to 36 months of loss of rent.
Engage a loss assessor. The loss adjuster wants to limit the indemnity period; we push for the full period needed.
Track the reinstatement timeline. Each delay extends the loss of rent claim.
Document re-letting effort once works are complete. Some policies require evidence the property was actively marketed.
Negotiate the loss of rent settlement.
Confirm the settlement is paid net of VAT and tax considerations.
Remember, loss of rent and reinstatement are two heads of cover. Both should be claimed, even when the insurer focuses on the buildings damage first.
What is considered a loss of rent insurance claim?
Loss of rent cover pays the landlord’s lost rental income while the property is uninhabitable as a direct consequence of an insured peril (fire, flood, water damage, storm, malicious damage, etc.). It is calculated as the contractual rent multiplied by the period the property cannot be let, capped at the policy’s indemnity period.
Common scenarios for loss of rent claims
Property uninhabitable after a fire while reinstatement runs
Flooded property requiring full strip-out and drying
Major water damage from an escape of water
Storm damage that requires roof and structural repair
Malicious damage requiring extensive remediation
Subsidence-related works requiring vacant possession
Does insurance cover loss of rent?
Most Irish landlord and commercial property policies include a loss of rent section. Common conditions:
Indemnity period cap. 12, 24 or 36 months depending on the policy.
Pro-rata calculation. Insurers commonly reduce the claim where reinstatement could have been faster.
Re-letting requirement. Once habitable, the landlord must actively market the property.
Excluded perils. Loss of rent only applies where the underlying peril is covered.

Frequently asked
Common loss of rent claim questions
How is the loss of rent calculated, and how long does cover run?
It is the contractual rent multiplied by the period the property is uninhabitable, capped at the policy's indemnity period (typically 12, 24 or 36 months). We push for the full indemnity period and confirm the rent figure reflects the contract, not historical figures.
Will my premium go up if I make a claim?
Some claims trigger a premium increase, some don't, and accidental-damage claims behave very differently from theft or subsidence claims. We'll advise on the wider implications BEFORE you decide to claim, not just push every loss through.
Is the loss adjuster the insurer sent on my side?
No. The loss adjuster works for the insurance company, their job is to validate the claim and contain its cost. Your loss assessor (us) works only for you, the policyholder. They are not the same role.
How much do you cost? When do I pay?
No win, no fee. Our fee is a percentage of the additional settlement we secure above the insurer's opening offer, agreed in writing up front. If we cannot improve on what the insurer would have paid you anyway, you owe nothing.
Can you visit me anywhere in Ireland?
Yes. Our office is in Dublin 6W and we serve every Irish county. Same-day site visits are routine for emergencies; standard non-emergency visits within 48 hours.
I've already made my claim and the insurer has offered me a settlement. Is it too late?
Not at all. We can step in at any stage of a claim, even after an offer has been made, and frequently improve the settlement. Don't accept the offer until you've spoken to us, signing accepts the figure as final.
